Child custody when one parent is facing deportation

by admin

I got divorced in Miami and I am currently living in Houston, Texas. My ex-wife is currently at a detention center and is going to be deported. What do I need to do in order to get full custody of my daughter being that her mother will no longer live in this country and I do not want my daughter (US citizen) going with her to her country of origin. Thank you.

From what i see you need to get back in court and have youself declared the custodial parent. Then you need to legally enforce the court order of custody.

You need to act with the child still in the USA. Many nations do not belong to the international child support treaty. Those nations, like Japan, will ignore your requests for child custody, even if you are the custodial parent.

An attorney qualified in that area is best. Act now before it becomes an international issue.
