I keep getting calls from the bank, saying it will foreclose on my property. What do I do?

First of all tell bank you have not received any formal letters, only these calls, and ask them for agreement of repayment plan or other plan they may have available. Most banks handle the situation in a professional manner, while others use the phone simply to let borrower realize they need to come up with the money. Since the borrower’s situation is that of not being able to pay for the months already owed, homeowner must contact an attorney as soon as possible. Just because bank is making these constant calls which lead you to think it’s all about talk, they can suddenly go the next step which is to file in court to get house back.

Do not wait till that happens because you will find that time is against you after foreclosure process starts. Consult with attorney or legal clinic to explore all venues, which might include a bankruptcy. Bankruptcy does not mean you get to keep the house automatically, but it will help you with all other debts you have. Having to pay less for other outstanding debts will help you have more funds available each month.

Write a letter to bank saying that you know you are behind in your payments, that you do not wish to lose the home and that you need a repayment plan or some other agreement. Certify the letter and send it with return receipt request.

Sigo recibiendo llamadas del banco, diciendo que van a llevar la casa a FORECLOSURE. Qué hago?

Primero que nada digale al banco que ustéd no ha recibido ninguna carta formal, solamente estas llamadas y que ustéd desea recibir un acuerdo de re-pago u otro tipo de plan que ellos tengan disponible. Re-pago en inglés se conoce como “repayment”. La mayoría de los bancos manejan todas las situaciones muy profesionalmente, mas otros simplemente utilizan el teléfono como medio para hacer saber al cliente el hecho de que ellos están atrasados y tienen que buscar el dinero. Como la situación del prestatario (ustéd), es de no poder pagar los meses que ya debe, ustéd debe contactar a un abogado o clinica legal lo antes posible. Solo porque el banco esté haciendo llamadas constantes, que le hagan pensar a ustéd que quizás todo se arregle de alguna forma y que el banco solo está tratando de intimidarlo, no se confíe, puesto que en un instante el banco puede hacer el foreclosure, pidiendole a la corte que ustéd devuelva la casa.

No espere a que esto suceda pués ustéd se encontrará con que tiene el tiempo en su contra una vez que el proceso empieze. Consulte con abogado o clinica legal cual sería la major forma de proceder. Posiblemente una bancarrota le ayude. Bancarrota no quiere decir que ustéd automáticamente se queda con la casa, pero sí le puede ayudar en cuanto a todas sus otras deudas. Teniendo ustéd que pagar menos por sus deudas pendientes, le ayuda a tener mas fondos disponibles mensualmente.

Escriba una carta al banco diciendo que ustéd sabe que está atrasado en sus pagos de hipoteca, que ustéd no desea perder su casa y que necesita un plan de repago u otro plan. Certifique esta carta y envíela por correo con “return receipt”.

Yes. The code enforcement can get upset if you do not. If they find it they can fine you. Call your local building department for all the rules concerning sheds. If sheds are allowed, they should require a permit and have to be hurricane resistant.

Miami Dade County still requires original suits to be filed at the Clerk of the Courts office along with the payment.
